General Information

Overview

Revenue Law is an important consideration for those engaging in legal practice insofar as issues arising out of revenue law will impact on advice given in a range of different situations. This unit gives an understanding of the underlying concepts of revenue law focusing on the Income Tax Assessment Acts and supporting legislation as well as looking at other important areas of revenue law practice which impact on advice given such as Goods and Services Tax and Fringe Benefits Tax.

Prerequisites: LAWS11057 and LAWS11059

Students who do not drop the unit in this timeframe cannot later drop the unit without academic and financial liability. Attendance Requirements

All on-campus students are expected to attend scheduled classes – in some units, these classes are identified as a mandatory (pass/fail) component and attendance is compulsory. International students, on a student visa, must maintain a full time study load and meet both attendance and academic progress requirements in each study period (satisfactory attendance for International students is defined as maintaining at least an 80% attendance record).

Assessment Grading

This is a graded unit: your overall grade will be calculated from the marks or grades for each assessment task, based on the relative weightings shown in the table above. You must obtain an overall mark for the unit of at least 50%, or an overall grade of ‘pass’ in order to pass the unit. If any ‘pass/fail’ tasks are shown in the table above they must also be completed successfully (‘pass’ grade). You must also meet any minimum mark requirements specified for a particular assessment task, as detailed in the ‘assessment task’ section (note that in some instances, the minimum mark for a task may be greater than 50%). Consult the University’s Grades and Results Policy for more details of interim results and final grades.

Task Description

This written assignment is a research essay that requires you to consider when a taxpayer may be able to claim deductions for losses or outgoings, with reference to several key judicial decisions including (but not limited to) Steele v Deputy Commissioner of Taxation (1999) 41 ATR 139, Commissioner of Taxation v Payne (2001) 177 ALR 270, and Commissioner of Taxation v Anstis (2010) 241 CLR 443.  Specifically, you will be required to discuss the implications, if any, of these judicial decisions on the development of the notion that there must be sufficient nexus between the loss or outgoing with the income earning activities of the taxpayer.


You are required to submit one WORD document( not PDF) containing all parts of your Written Assessment with the document name as your student name with student number (e.g. Peter Smith s001234)

Task Description

This is a research task that requires you to provide advice to Sally, who has received a Notice of Amended Assessment from the Australian Taxation Office (ATO). You will be required to:

(1) Advise Sally as to her grounds for objection (if any) to the Notice of Amended Assessment issued by the ATO (issues include taxation of capital gains, source of income and assessable income)

(2) Discuss and detail the process of objecting to the Notice of Amended Assessment, including any relevant time frames of which Sally should be aware.

(3) Briefly discuss whether either the Inspector General of Taxation or the Tax Ombudsman are likely to be of help should Sally wish to complain about the auditor’s behaviour.
