General Information

Unit Synopsis

This unit aims to provide students with a basic grounding in the context and main sources of Environmental Law in Australia, together with the major State and Commonwealth legislative regimes which collectively comprise Australia's system of environmental regulation. Topics covered include: aspects of the Australian legal system- State- Commonwealth jurisdiction in relation to environmental regulation- environmental property rights- access to and management of the environment- environmental protection and the enforcement of environmental controls- and, an overview of the economic approach to environmental regulation.

Attendance Requirements

All on-campus students are expected to attend scheduled classes – in some units, these classes are identified as a mandatory (pass/fail) component and attendance is compulsory. International students, on a student visa, must maintain a full time study load and meet both attendance and academic progress requirements in each study period (satisfactory attendance for International students is defined as maintaining at least an 80% attendance record).

Each 6-credit Undergraduate unit at CQUniversity requires an overall time commitment of an average of 12.5 hours of study per week, making a total of 150 hours for the unit.

This is a graded unit: your overall grade will be calculated from the marks or grades for each assessment task, based on the relative weightings shown in the table above. You must obtain an overall mark for the unit of at least 50%, or an overall grade of ‘pass’ in order to pass the unit. If any ‘pass/fail’ tasks are shown in the table above they must also be completed successfully (‘pass’ grade). You must also meet any minimum mark requirements specified for a particular assessment task, as detailed in the ‘assessment task’ section (note that in some instances, the minimum mark for a task may be greater than 50%).

Feedback
Students find the textbook readings demanding, which is understandable for environmental science students. However, it is necessary for students to cover the material in the textbook and that means reading law.
Recommendation
Additional written materials should be provided to clarify key concepts from the textbook and these should become the focus of the weekly tutorial class.
Action Taken
Additional weekly class notes were prepared and provided to students prior to each class, specifically to address this recommendation.

Unit learning Outcomes

On successful completion of this unit, you will be able to:

  1. delineate the basic structure, institutions, key functions and processes of the Australian legal system within which environmental law operates
  2. undertake - with reference to the relevant sources of legal authority - expository and analytical accounts of major topics and key issues such as environmental property rights, access to and management of the environment, environmental protection measures and environmental litigation
  3. recognise, extract and respond appropriately to the types of legal problems and issues likely to be embedded in commonly encountered environment-related activities
  4. appreciate the desirability of managing transactions and activities upon which environmental law may impinge in a pro-active manner, so as to maximally exploit any potentially applicable benefits, incentives and shelters, as well as legally circumventing the application of otherwise avoidable regulatory disincentives and penalties.
