General Information

Unit Synopsis

This course builds on the foundations laid in the pre-requisite course LAWS12065, Foundations of Property Law, being the second of two core property law courses for students enrolled in the LLB program. The course has a specific focus on the law of real property, covering the following themes: the concept of land; native title and indigenous rights to land; land registration systems with an emphasis on the Torrens system of land registration and the impact of e-technology; co-ownership; leases; mortgages; easements and covenants; strata and community title; and aspects of ownership and tenancy in public and community housing.

Prerequisities:

LAWS11057 Introduction to Law; and

LAWS11059 Statutory Interpretation;

LAWS12065 Foundations of Property Law; and 

24 units of credit (4 courses) in the LLB program.

Important note: Students enrolled in a subsequent unit who failed their pre-requisite unit, should drop the subsequent unit before the census date or within 10 working days of Fail grade notification. Students who do not drop the unit in this timeframe cannot later drop the unit without academic and financial liability. Attendance Requirements

All on-campus students are expected to attend scheduled classes – in some units, these classes are identified as a mandatory (pass/fail) component and attendance is compulsory. International students, on a student visa, must maintain a full time study load and meet both attendance and academic progress requirements in each study period (satisfactory attendance for International students is defined as maintaining at least an 80% attendance record).

Each 6-credit Undergraduate unit at CQUniversity requires an overall time commitment of an average of 12.5 hours of study per week, making a total of 150 hours for the unit.

This is a graded unit: your overall grade will be calculated from the marks or grades for each assessment task, based on the relative weightings shown in the table above. You must obtain an overall mark for the unit of at least 50%, or an overall grade of ‘pass’ in order to pass the unit. If any ‘pass/fail’ tasks are shown in the table above they must also be completed successfully (‘pass’ grade). You must also meet any minimum mark requirements specified for a particular assessment task, as detailed in the ‘assessment task’ section (note that in some instances, the minimum mark for a task may be greater than 50%).

Unit learning Outcomes

On successful completion of this unit, you will be able to:

  1. Understand and explain the conceptual features of land under Australian law.
  2. Explain and evaluate the framework of Native Title under the Native Title Act 1996 (Cth), how Native Title is extinguished and the nature of indigenous land claims.
  3. Explain and critically evaluate systems of land registration with an emphasis on the Torrens system and unregistered interests in Torrens land and the impact of e-technology.
  4. Explain and crictically evaluate important themes in land law including: Co-ownership; Leases under general law; Mortgages; Easements and Covenants; and the management of land where ownership is divided including strata and community title.
  5. Understand and critique the nature of future interests in land and the legal regime governing perpetuities.
  6. Understand and evaluate aspects of ownership and tenancy in social housing.
